Accommodation Policy

Article 1: Scope of Application

  1. The accommodation contracts and related agreements concluded between the hotel and its guests shall be governed by these Terms and Conditions. Matters not provided for in these Terms and Conditions shall be governed by applicable laws and regulations or generally established customs.
  2. Where the hotel has agreed to special provisions to the extent they do not conflict with laws and customs, such special provisions shall prevail notwithstanding the preceding paragraph.

Article 2. Application for an Accommodation Contract

  1. A person seeking to apply for an accommodation contract with the hotel shall provide the hotel with the following information.
    • Guest name
    • Date of stay and scheduled arrival time
    • Accommodation charges (in principle, as set forth in Appendix 1)
    • Other matters deemed necessary by the hotel
  2. If a guest requests, during their stay, to extend their accommodation beyond the departure date set forth in item 2 of the preceding paragraph, the hotel shall treat such request as a new application for an accommodation contract at the time the request is made.
  3. If the hotel requests the person who has applied for accommodation to submit a guest register stating the guest’s name, address, telephone number, and other particulars, that person shall submit it immediately, even after the accommodation contract has been concluded.

Article 3: Formation, etc. of Accommodation Contract

  1. The accommodation contract shall be concluded when the hotel accepts the application set forth in the preceding article. However, this shall not apply where the hotel proves that it did not accept the application.
  2. When the accommodation contract has been concluded pursuant to the provisions of the preceding paragraph, the guest shall pay, by the date specified by the hotel, an application deposit set by the hotel in an amount not exceeding the basic accommodation charges for the accommodation period, or for 3 days where the accommodation period exceeds 3 days.
  3. The application deposit shall first be applied to the accommodation charges ultimately payable by the guest, and, if circumstances arise requiring the application of the provisions of Articles 6 and 17, it shall be applied in the following order: first to cancellation charges, then to compensation. If any balance remains, it shall be refunded at the time of payment of the charges under Article 12.
  4. If the application deposit set forth in paragraph 2 is not paid by the date specified by the hotel pursuant to the provisions of that paragraph, the accommodation contract shall lose its validity. However, this shall apply only where the hotel has notified the guest to that effect in specifying the due date for payment of the application deposit.

Article 4: Special Agreement Not Requiring Payment of Application Deposit

  1. Notwithstanding the provisions of paragraph 2 of the preceding article, the hotel may enter into a special agreement not requiring payment of the application deposit set forth in that paragraph after the contract has been concluded.
  2. If, upon accepting an application for an accommodation contract, the hotel does not request payment of the application deposit set forth in paragraph 2 of the preceding article, or does not specify the due date for payment of such application deposit, it shall be treated as though the hotel has entered into the special agreement set forth in the preceding paragraph.

Article 5: Refusal of Accommodation Contract

The hotel may refuse to conclude an accommodation contract in the following cases:

  • Where the application for accommodation does not conform to these Terms and Conditions.
  • Where no guest room is available due to full occupancy.
  • Where it is recognized that a person seeking accommodation is likely to commit an act in connection with accommodation that violates laws or regulations, public order, or good morals.
  • Where a person seeking accommodation is an organized crime group, a member of an organized crime group, an entity or person affiliated with an organized crime group, or any other anti-social force.
  • Where a person seeking accommodation is a corporation or any other organization whose business activities are controlled by an organized crime group or a member of an organized crime group.
  • Where a person seeking accommodation is a corporation and any of its officers is a member of an organized crime group.
  • Where a person seeking accommodation makes violent demands against the hotel or its employees, or demands a burden beyond a reasonable scope.
  • Where it is clearly recognized that a person seeking accommodation is suffering from a contagious disease.
  • Where accommodation cannot be provided due to a natural disaster, facility failure, or other unavoidable cause.
  • Where a person seeking accommodation is likely to cause annoyance to other guests due to intoxication or other reasons, or has engaged in words or conduct that causes significant annoyance to other guests, or is likely to do so.
  • Where a person who has applied for accommodation has made the application while concealing an intention to profit personally through resale, brokerage for a fee, or similar arrangements in relation to the reserved room.
  • Where the case falls under the provisions of the Travel Agency Act or the ordinances for enforcement of the Hotel Business Act established by the relevant prefecture.

Article 6: Guest’s Right to Cancel Accommodation Contract

  1. The guest may cancel the accommodation contract by notifying the hotel.
  2. If the guest cancels all or part of the accommodation contract due to reasons attributable to the guest, the hotel shall charge cancellation fees as set forth in Appendix 2. However, where the hotel has entered into the special agreement set forth in Article 4, paragraph 1, this shall apply only if, in entering into that special agreement, the hotel has notified the guest of the guest’s obligation to pay cancellation fees in the event of cancellation of the accommodation contract. This excludes cases where, pursuant to Article 3, paragraph 2, the hotel has specified the due date for payment of the application deposit and requested such payment, and the guest cancels the accommodation contract before making that payment.
  3. If the guest does not arrive by 8:00 p.m. on the day of the stay, without contacting the hotel, or, where the expected time of arrival has been specified in advance, within two hours after that time, the hotel may treat the accommodation contract as having been cancelled by the guest. However, this shall not apply where it is recognized that the failure to arrive is due to the suspension or delay of public transportation or other circumstances not attributable to the guest.

Article 7: The Hotel’s Right to Cancel the Contract

  1. The hotel may cancel the accommodation contract in the following cases:
    • Where it is deemed that a guest is likely to commit, or has committed, an act in connection with their accommodation that violates laws and regulations, public order, or good morals.
    • Where it is clearly recognized that a guest is suffering from a contagious disease.
    • Where accommodation cannot be provided due to force majeure, including natural disasters.
    • Where the guest is an organized crime group, a member of an organized crime group, an organization or person related to an organized crime group, or any other anti-social force.
    • Where the guest is a corporation or other organization whose business activities are controlled by an organized crime group or a member of an organized crime group.
    • Where the applicant is a corporation and any of its officers is a member of an organized crime group.
    • Where a guest makes violent demands against the hotel or its employees, or requests a burden exceeding a reasonable scope.
    • Where the case falls under Article 5 of the Nagano Prefecture Ordinance for Enforcement of the Hotel Business Act.
    • Where a guest is likely to cause annoyance to other guests due to intoxication or other reasons, or has engaged in words or conduct that causes significant annoyance to other guests.
    • Where a guest smokes in the guest room, tampers with fire-fighting equipment, or otherwise fails to comply with prohibited matters set forth in the hotel’s rules of use, limited to those necessary for fire prevention.
  2. If the hotel cancels the accommodation contract pursuant to the provisions of the preceding paragraph, the hotel shall not charge the guest for any accommodation services not yet provided.

Article 8: Registration of Accommodation

  1. The guest shall register the following particulars at the front desk of the hotel on the day of the stay:
    • Guest’s name, age, gender, address, and occupation
    • In the case of foreign nationals: nationality, passport number, place of entry, and date of entry into Japan
    • Date of departure and scheduled time of departure
    • Other matters deemed necessary by the hotel
  2. If the guest intends to pay the charges under Article 12 by any means other than currency, such as traveler’s checks, accommodation vouchers, or credit cards, the guest shall present such means in advance at the time of registration set forth in the preceding paragraph.

Article 9: Room Usage Hours

  1. The hours during which the guest may use the hotel room shall be from 3:00 p.m. until 10:00 a.m. the following morning. This may vary depending on the accommodation plan. However, in the case of consecutive stays, the guest may use the room throughout the day, excluding the arrival day and the departure day.
  2. Notwithstanding the provisions of the preceding paragraph, the hotel may permit the use of guest rooms outside the hours specified in that paragraph. In such cases, the hotel shall charge the additional fees set forth in the hotel’s rules of use.

Article 10: Compliance with the Rules of Use

Guests shall comply with the rules of use established by the hotel and posted within the hotel.

Article 11: Business Hours

  1. Detailed business hours of the hotel’s facilities shall be provided by notices posted in various locations and by televisions equipped in guest rooms.
  2. The hours referred to in the preceding paragraph may be changed temporarily where necessary and unavoidable. In such cases, notice shall be given by appropriate means.

Article 12: Payment of Charges

  1. The breakdown of the accommodation charges and other fees payable by the guest, and the method of calculation thereof, shall be as set forth in Appendix 1.
  2. Payment of the accommodation charges and other fees referred to in the preceding paragraph shall be made at the front desk, at the time of the guest’s departure or when requested by the hotel, in currency or by credit card or any other means approved by the hotel.
  3. If, after the hotel has provided the guest room and made it available for use, the guest voluntarily chooses not to stay, the accommodation charge shall still be due.

Article 13: Liability of the Hotel

  1. If, in the performance of the accommodation contract or any related agreement, or due to non-performance thereof, the hotel causes damage to the guest, the hotel shall compensate the guest for such damage. However, this shall not apply where such damage is not attributable to the hotel.
  2. The hotel conducts regular fire safety inspections in accordance with the Fire Service Act and maintains corporate liability insurance in order to respond to any fire or other emergency.

Article 14: Handling Where a Contracted Guest Room Cannot Be Provided

  1. If the hotel is unable to provide the guest with the contracted room, it shall, with the guest’s consent, arrange other accommodation under the same conditions to the extent possible.
  2. Notwithstanding the provisions of the preceding paragraph, if the hotel is unable to arrange other accommodation, it shall pay the guest compensation equivalent to the cancellation charges, and such compensation shall be applied to damages. However, if the inability to provide the room is not attributable to the hotel, the hotel shall not pay such compensation.

Article 15: Handling of Deposited Articles, etc.

  1. The hotel does not accept cash or valuables for safekeeping. Valuables should be kept in the safe provided in the guest room. The guest shall manage articles placed in the safe at the guest’s own responsibility, and the hotel shall not be liable as a depository for such articles.
  2. With respect to articles, cash, or valuables brought into the hotel by the guest and not deposited at the front desk, if loss, damage, or other harm is caused by the hotel’s willful misconduct or negligence, the hotel shall compensate for such damage. However, with respect to articles for which the guest has not declared in advance their type and value, the hotel shall not compensate for such damage unless the hotel has acted with willful misconduct or gross negligence.

Article 16: Custody of Guests’ Luggage or Personal Belongings

  1. If a guest’s luggage arrives at the hotel prior to the guest’s stay, the hotel shall store it at its responsibility only where the hotel has understood and agreed to do so before its arrival, and shall hand it to the guest at the front desk at the time of check-in.
  2. In the case referred to in the preceding paragraph, acceptance of luggage shall be subject to the conditions that the guest’s name and date of stay match the reservation information, and that the luggage does not include cash, valuables, fragile items, dangerous items, perishable goods requiring refrigeration or freezing, or any other articles that the hotel deems unsuitable for storage.
  3. The hotel may refuse to accept luggage that does not satisfy the conditions set forth in the preceding paragraph, and shall not be liable in any respect for alteration of its contents, loss, theft, or any other damage.
  4. If, after the guest has checked out, cash or valuables of the guest are found left behind at the hotel, the hotel shall contact the owner and seek instructions. However, if no instructions are received from the owner or if the owner cannot be identified, such items shall, in principle, be kept for seven days including the date of discovery and thereafter delivered to the nearest police station. Other items shall be disposed of after two months. Among lost items, food and beverages shall be disposed of on the day of discovery for hygiene reasons. Tobacco products, magazines, and other similar consumable items shall be disposed of on the day following check-out.

    * “Cash and valuables” means items of a certain value, such as wallets containing cash, credit cards, cameras, mobile phones, watches, precious metals, and prepaid cards, as well as items such as driver’s licenses and insurance cards that may be misused by third parties.

  5. In the cases referred to in the preceding two paragraphs, the hotel’s responsibility for the custody of guests’ luggage or personal belongings shall, in the case of paragraph 1, be governed by Article 15, paragraph 1, and in the case of the preceding paragraph, by Article 15, paragraph 2.

Article 17: Liability for Parking

When a guest uses the parking lot of the hotel or of the building in which the hotel is located, regardless of whether the vehicle key has been entrusted to the hotel, the hotel and the building in which the hotel is located merely provide the parking space and do not assume responsibility for the management of the vehicle. However, where damage is caused through the hotel’s willful misconduct or negligence in the management of the parking lot, the hotel shall be liable for compensation.

Article 18: Liability of Guests

If the hotel suffers damage due to the guest’s willful misconduct or negligence, the guest shall compensate the hotel for such damage.

Article 19: Handling of Pets

  1. Handling of assistance dogs for persons with disabilities
    Guests who use guide dogs, service dogs, or hearing dogs (hereinafter collectively referred to as “assistance dogs”) shall use the hotel upon understanding and agreeing to the following matters.
    • Before entering the hotel, guests may be asked, if necessary, to present an ID card (certificate of eligibility).
    • Where it is recognized that there is a risk of damage to the hotel facilities or of causing inconvenience to other guests, access may be restricted.
    • If damage to or soiling of the hotel is caused by an assistance dog, the guest shall compensate the hotel for the actual costs of cleaning and repair in accordance with Article 18 (Responsibilities of Guests).
    • Guests shall comply with the provisions of the Assistance Dogs for Persons with Disabilities Act.
  2. Accommodation with Ordinary Pets
    • Where a guest stays accompanied by an animal other than an assistance dog (hereinafter referred to as a “pet”), the guest shall agree to the hotel’s Pet Accommodation Policy and use the designated guest room.
    • Accommodation with a pet shall be permitted only where the guest has applied in advance at the time of reservation and the hotel has approved such request.
    • As a general rule, pets are prohibited from accompanying guests into the restaurant, the public bath, and other public spaces designated by the hotel. *If exceptions apply, such as where the pet is kept in a cage, this will be stated separately.
    • Guests shall comply with the hotel’s instructions and rules of use, including placing pets in a cage or keeping them on a leash when moving within the hotel (outside the guest room).

Article 20: Disclaimer

With respect to the use of computer communications from within the hotel, the guest shall use such communications at the guest’s own responsibility. Even if the service is interrupted during use of computer communications due to system failure or any other reason, and the user suffers any loss as a result, the hotel shall bear no responsibility whatsoever. Further, if damage is caused to the hotel or to a third party by conduct that the hotel deems inappropriate in connection with the use of computer communications, the guest shall compensate for such damage.

Article 21: Protection of Personal Information

Personal information disclosed by the guest in connection with the accommodation contract shall be managed in accordance with the Act on the Protection of Personal Information.

Article 22: Governing Language

These Terms and Conditions are prepared in both Japanese and English. In the event of any inconsistency or discrepancy between the two versions, the Japanese version shall prevail.

Article 23: Payment of Fees

Remarks

  1. The percentages indicate the cancellation fee rate relative to the accommodation charge.
  2. This may vary depending on the accommodation plan. The policy established for the relevant accommodation plan shall take precedence.
  3. The group rate applies where the number of rooms used per day is eight or more.
